A MAN who made homophobic remarks to a police officer has been ordered to carry out unpaid work.

Gerard McGonigle, of Hogganfield, appeared at Glasgow Sheriff Court on Tuesday.

He previously pleaded guilty to uttering the homophobic remarks towards a cop, and assaulting an officer by pulling him by the body, seizing him by the arm, pulling him on to a bed and attempting to headbutt him.

The court heard that police attended at his address on Lochview Drive for an unrelated matter on March 1, last year.

The procurator fiscal depute added: “Whilst police were present the accused began to argue with them including asking them to leave.

“He was arrested. He resisted arrest by flexing his arms. He was shouting at police.

“He said to one of the police officers ‘you like that ya p**f. He said to one of the officers that they were a ‘homosexual’.

“He lunged forward and attempted to headbutt an officer. He banged his nose on the officer and his nose began to bleed.

“The officer did not suffer any injury. When he was cautioned and charged, he was dismissive and said, ‘I can’t hear you’.”

McGonigle’s lawyer said her client accepts responsibility for his actions.

She said: “Mr McGonigle would comply with unpaid work, but I appreciate there may be difficulties given the circumstances we are currently facing. Another consideration would be a restriction of liberty order.”

Sheriff Barry Divers told McGonigle: “I take into account everything that’s been said on your behalf. This type of behaviour is serious enough that I’m going to order you to carry out unpaid work. This will be 160 hours. In the present circumstances, you will be given one year to complete these hours.”
